1. Introduction
Welcome to CrewVal. These Terms and Conditions (“Terms”) govern your access to and use of the CrewVal platform, including our website, web application, mobile application, and related services (collectively, the “Service”).
By creating an account or using the Service in any way, you confirm that you have read, understood, and agree to be bound by these Terms and our Cookie Policy. If you do not agree, please discontinue use of the Service immediately.
2. Definitions
- Platform / Service
- The CrewVal website, web app, and mobile app.
- User
- Any individual who registers an account on the Platform, including offshore workers, agency staff, and administrators.
- Worker
- A User who registers as an offshore worker seeking employment opportunities.
- Agency
- A recruitment agency or employer that uses the Platform to source and manage offshore workers.
- Content
- Any data, text, files, documents, certificates, profiles, or other material uploaded or submitted to the Platform.
- We / Us / Our
- CrewVal and its operators.
3. Eligibility
To use CrewVal you must:
- Be at least 18 years of age.
- Have the legal capacity to enter into a binding contract.
- Not be prohibited from using the Service under applicable law.
- Provide accurate and complete registration information.
By registering, you represent and warrant that you meet all eligibility requirements. We reserve the right to refuse or terminate accounts at our sole discretion.
4. Account Registration and Security
You are responsible for maintaining the confidentiality of your login credentials. You agree to:
- Provide accurate, current, and complete information during registration.
- Keep your password secure and not share it with anyone.
- Notify us immediately at legal@crewval.com if you suspect any unauthorised access to your account.
- Accept responsibility for all activity that occurs under your account.
5. Use of the Service
5.1 Permitted Use
You may use CrewVal solely for lawful purposes and in accordance with these Terms. Workers may create profiles, upload documents and certificates, set availability, and respond to job opportunities. Agencies may search for workers, post opportunities, and manage recruitment workflows.
5.2 Prohibited Conduct
You agree not to:
- Upload false, misleading, or fraudulent information or documents.
- Impersonate any person or entity.
- Use the Service for any unlawful purpose or in violation of any applicable regulations.
- Attempt to gain unauthorised access to the Platform, other accounts, or connected systems.
- Scrape, crawl, or use automated tools to extract data from the Service without prior written consent.
- Transmit viruses, malware, or other harmful code.
- Harass, abuse, or harm any other user.
- Resell or commercially exploit the Service without authorisation.
- Circumvent any access controls or security features.
6. Content and Intellectual Property
6.1 Your Content
You retain ownership of the Content you upload to CrewVal (e.g., your CV, certificates, profile information). By uploading Content, you grant CrewVal a non-exclusive, worldwide, royalty-free licence to store, display, and transmit that Content solely for the purpose of providing the Service to you and, where applicable, to authorised Agencies you interact with.
6.2 Platform Intellectual Property
The CrewVal name, logo, design, software, and all associated intellectual property are owned by or licensed to CrewVal. Nothing in these Terms transfers any intellectual property rights to you. You may not copy, modify, distribute, or create derivative works based on our intellectual property without express written permission.
6.3 Accuracy of Content
You are solely responsible for the accuracy and legality of all Content you upload. Uploading fraudulent qualifications or certifications may constitute a criminal offence and will result in immediate account termination and referral to relevant authorities.
7. Privacy and Data Protection
Your use of the Service is also governed by our Cookie Policy. By using CrewVal, you consent to the collection and use of your data as described therein. We process personal data in accordance with applicable data protection legislation, including the GDPR where applicable.
We implement appropriate technical and organisational measures to protect your personal data against unauthorised access, alteration, disclosure, or destruction.
8. Third-Party Services
CrewVal may integrate with or link to third-party services (e.g., cloud storage, email providers, payment processors). These services are governed by their own terms and privacy policies. We are not responsible for the content, accuracy, or practices of third-party services.
9. Disclaimers and Limitation of Liability
9.1 No Employment Guarantee
CrewVal is a technology platform that facilitates connections between Workers and Agencies. We do not guarantee employment, the accuracy of job listings, or the conduct of any Agency or Worker. All employment arrangements are solely between the relevant parties.
9.2 Service Availability
We strive for high availability but do not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components. The Service is provided “as is” and “as available” without warranties of any kind, express or implied.
9.3 Limitation of Liability
To the maximum extent permitted by applicable law, CrewVal and its officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising from:
- Your use of or inability to use the Service.
- Any content obtained from the Service.
- Unauthorised access to or alteration of your transmissions or data.
- Conduct of any third party on the Service.
10. Termination
We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for conduct that we believe:
- Violates these Terms.
- Is harmful to other users, third parties, or the Service.
- Is required by applicable law or regulation.
You may delete your account at any time via the account settings page. Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.
11. Modifications to the Terms
We may update these Terms at any time. We will notify registered users of material changes via email or an in-app notification. Continued use of the Service after the effective date of any change constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
12. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with applicable law. Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, the dispute shall be submitted to the competent courts in the jurisdiction where CrewVal operates.
